Terms of use

General

The following terms and conditions (henceforth: the Terms and Conditions”) are valid between you and Acne Corp. (Reg. No. 371624968 New York) (henceforth: Acne Studios; may be referred to as “us” and “we”) and apply to all use of and orders placed on Acne Studios website acnestudios.com, and orders made by telephone, e-mail or by live chat with Acne Studio’s Customer Service team (henceforth together: the “Website”). Please note that Acne Studios does not guarantee that all products presented on the Website are in stock or are available for purchase. Acne Studios eserves its right to stop selling a product. Orders can only be placed by persons that are 18 years or older. Acne Studios reserves the right to revise the Terms and Conditions at any time. The date of the latest update is found in the final section of the Terms and Conditions. Users are responsible for keeping themselves updated with such changes. Please note that the terms and conditions valid for your order is always the terms and conditions that is in effect as of the time that you have placed your order and not a later version. You should keep a copy of these Terms and Conditions for future reference.

Language

The language of the Terms and Conditions is English.

My account

When creating an account online, you will be able to choose a password with which you can log in to your account online and view your order history and track your order. If you would like to delete an account you can also contact customercare@acnestudios.com and the customer care team will assist you. If you sign up, you can also chose to store a credit card for a future purchase. All information regarding your stored credit cards can be changed and deleted when logging in to your account. Your details will be protected using Global Sign Encryption and will speed up your checkout the next time you shop. Further membership policy information can be read here.

Placing order

By using the Website and/or placing an order on the Website, by telephone, e-mail or by live chat you confirm that you have read the Terms and Conditions and the Privacy Policy, and that you accept them; if you do not accept these Terms and Conditions and Privacy Policy, do not place an order. Please make sure that you have read and understood the Terms and Conditions before you place an order. Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. Please note that products in your shopping bag are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the Website to fail, your selection of products may be lost. In such case, you will be required to re-enter your selection of products to the shopping bag.

Order confirmation

After submitting your order, we will send you an order confirmation e-mail with your order number, details of the product you have ordered from us, your payment details and delivery details. Please note that the confirmation e-mail is an acknowledgement that we have received your order and is not an acceptance of the order.

Acceptance and shipping confirmation

Please note that all orders placed by you are subject to availability. Once the order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order. The shipping confirmation or pick-up notification is our acceptance of your order. Please note that Acne Studios does not guarantee that all products presented on the Website are in stock at the time of your order. If a product is unavailable, we will contact you shortly, by phone or by e-mail. If we already have received payment for such product, we will refund you the amount of the purchase.

Colors

Acne Studios’ goal is to describe the products at the Website as correctly as possible. However, please note that due to the color settings of your computer, the colors of the products shown in the pictures on the Website can differ somewhat from their actual colors. Acne Studios cannot be held responsible for any such discrepancy.

Prices

The prices and delivery costs shown on the Website include sales tax.The prices may vary between the physical store and the Website. Please also note the Acne Studios may cancel the order even if it has been accepted by Acne Studios under the condition that you realize or should have realized that the price information was incorrect. The delivery costs are shown in connection with the shipping methods at the checkout stage.

Personalised items

Personalised items are made to order and cannot be returned or exchanged. Once the order has been sent by the customer and confirmed by Acne Studios, the customer will be informed via an order confirmation email. Once the order is processed and accepted, the customer will receive a shipping confirmation email. Personalised items may be delivered in a time slot indicated on the site which may be longer than regular delivery slots. Because of the clearly personalized nature of personalised products and the fact that they are produced specifically for the customer, they cannot be returned, refunded or exchanged. Similar, the customer does not have the right to cancel the order.

Payments

The following payments are accepted.

Credit cards and debit cards

Payment can be made by the following credit cards: Visa, Mastercard and American Express. Payment can also be made by the following debit cards: Visa and Maestro. (Maestro and Visa Electron: please check with your bank to make sure your card is valid for online purchases). The purchases made with Visa and Mastercard are verified by a secure code. Please note that your card is debited with the purchase amount once Acne Studios has sent you the order confirmation email. We do our best to make the Website as secure as possible. All credit/debit card transactions on the Website are processed using Adyen, a secure online payment gateway that encrypts your card details in a secure host environment. Payment will be debited and cleared from your account upon acceptance of your order by Acne Studios. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Acne Studios, your order will be cancelled. We are not responsible for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order.

Pay Pal

When selecting the PayPal option, you will be directed to the PayPal site to “Log In” and review the amount shown before clicking “Pay Now”. Once this transaction is complete, you will then return to the Website.

Alipay

When selecting the Alipay option, you will be directed to the Alipay payment page, where you can either scan a given QR code or “Log In” to review the amount shown before approving such payment. Once the transaction is complete, you will then return to the Website.

Wechat pay

When selecting the Wechat Pay option, you will be directed to the Wehchat Pay payment page, where you can either scan a given QR code or “Log In” to review the amount shown before approving such payment. Once the transaction is complete, you will then return to the Website

Apple Pay

When selecting Apple Pay payment option, you will be directed to the Apple Pay payment page, where you can select your shipping address and confirm your payment with your device fingerprint.  Once the tranasction is complete, you will then return to the Website.

Pay Later in 4 installments

Pay Later in 4 installments is done in cooperation with Klarna and Klarnas payment terms apply. To read Klarna’s payment terms, please see here. If you choose to pay with Klarna - Pay Later in 4 installments, additional terms will apply between you and Klarna. These terms are presented at checkout.

Stored Credit Cards

At Checkout you can chose to save your credit card for future purchases if you are logged in to your Acne Studios account. Your details will be protected using Global Sign Encryption and will speed up your checkout the next time you shop.

Gift Cards

When placing an order with a gift card, the order can only be shipped to the same country as where the gift card was issued. Acne Studios are unable to change the currency of the gift card in order to use it in another country. Gift cards are valid five year from the date when they were purchased.

Delivery

Shipping methods

We offer different shipping methods to meet your needs as further specified when you check out. Dispatch of orders may take up to 7 business days but we aim to dispatch all orders within 24 hours during weekdays, or 1-2 business days during sales periods. Please note that delivery times are provided as guidelines only, and commence from the date of dispatch. The delivery times do not take into account possible delays caused by payment authorization and/or stock availability. If Acne Studios fails to deliver within 30 days, you may have the right to cancel the purchase. Your order will be delivered by UPS to the shipping address you have indicated, or to the store you have indicated if you have elected to collect in store. Orders are fully traceable on the Website by logging in to My account. Click “My Orders” and fill in the tracking number for updated information about your shipment. For orders you have chosen to collect in store, tracking information will not be displayed – please wait for an email notification stating that your item is ready to be picked up.

First-time order policy

For security purposes, Acne Studios reserves the right to ship first-time orders to the cardholder's verified billing address or work address. To avoid delays in receiving your order, please make sure to provide the correct billing and shipping information associated with your credit/debit card when placing an order.

Returns and exchanges

Returns

You are entitled to return your purchase for a refund or exchange your product/s by submitting or sending notice thereof to Acne Studios and postmarking/dispatching the product/s within 14 days of the date on which you have received the product, provided the product has not been materially used or worn.

The notice may be sent to us using our electronic Return Merchandise Authorization (RMA) system by logging into you acnestudios.com account and following the instructions in this section. Please note that you of course do not need to use the electronic system but may send us an e-mail to the customercare@acnestudios.com with (i) your order information, and (ii) that you request a refund or seek to exchange your purchase.

Please include the order number of the transaction with your request. In due course, we will send you a confirmation that we have received your notice and that it is being processed. Please always refer to your order number in all communications with us. You may wish to keep a copy of your return/exchange request for your own records.

Upon sending notification to us of your return or exchange request, please return the product/s as soon as reasonably practicable but no later than 7 days after sending your notice.

When returning please follow the steps below.

  • Visit www.acnestudios.com and log into your account to begin a return or exchange.
  • Click on “Orders”
  • Find the order you would like to return/exchange, and click on "Return an item" to begin the return/exchange process.
  • Select which item(s) you would like to return, exchange, and then a resolution (whether you want a refund or exchange), and also the reason for return.  Kindly note that you must add each item one at a time, so once you have added the first item you can add other items from your order.
  • After you have completed the return/exchange request, place the pre-paid return label on the box over the prior delivery information.
  • Close the box and tape securely.
  • Call UPS at 1-800-PICK-UPS (1-800-742-5877) to arrange a collection.

We prefer that products be returned through Acne Studios return service to ensure they are protected and insured during transit. However, you may return the products by any secure transport.

Refund relating to returns

If you choose to return your purchase in accordance with the terms set forth in this section 11, Acne Studios will issue a refund of the amount paid to Acne Studios. However, if Express shipping has been used, Acne Studios will not issue a refund of the original shipping fee. Acne Studios will pay the refund within 14 days of the date on which we have received your notice of return/exchange, under the condition that Acne Studios has received the product/s from you or if Acne Studios has obtained proof that the products have been sent back to Acne Studios. The refund is made using the same payment method you used at the purchase if you do not explicitly accept another method. You will not be charged extra if another payment method is used.

Please note that Acne Studios only issues a full refund if the product/s is in the same conditions as at the time of delivery. If the products’ value has diminished due to your handling of the products to a greater extent than is necessary in order to ascertain its characteristics or function, you have an obligation to reimburse us. Thus, Acne Studios then has the right to withhold such amount of the refund.

To avoid a deduction, please make sure the product you wish to refund is in the exact same condition as when you received them, with tag and seal still attached. All shoes must not be used at all or on a carpeted surface until you have decided to keep them. Shoes and accessories that come in a special box, must be returned in their undamaged original box which is considered to be a part of the product.

Exchanges

Purchased products are exchangeable into a different size in accordance with the terms set forth in this section 11. All exchanges are based on stock availability. If you have exchanged a product, Acne Studios will pay the shipping costs for the new product.

Shipping costs for returning the products

Acne Studios offer a free return service and Acne Studios will pay the shipping cost for returning the products sent from the U.S. for a refund or an exchange.

Returning ‘collect in store’ orders

Should you have chosen to collect an order placed on acnestudios.com in a store, the item will be held in store for a period of 14 days from, and including, the date on which you receive a notification email that the order is ready to be picked up. If the order is not picked up within that period, Acne Studios will refund the full order balance to the payment source used for the original purchase. Once your order is collected in store, the terms listed above for returns and exchanges of orders placed on acnestudios.com apply. As you will not receive a pre-paid return label when you collect in store, please contact customercare@acnestudios.com with your order information and request that a label be sent to you.

Final Sale

Discounted items purchased during Acne Archive pop-up sale are Final Sale, and therefore not eligible for return or exchange.

Defective products

If you receive defective products, please notify us immediately and within a reasonable time after you have detected that the products are defective. If Acne Studios reasonably determines that the products are in fact defective, Acne Studios reserve the right to send you a non-defective identical replacement item will make a full refund to you, including shipping costs.

Acne Studios' quality guarantee

Acne Studios acts in accordance with applicable consumer regulations. Please notify us as soon as possible after receiving defective products.

Security

Acne Studios use Secure Socket Layers (SSL), the industry standard in transferring information to process your orders. Acne Studios online shop secures communications by encrypting all data to and from the site. When placing an order, you can immediately check the security validity by clicking the Thawte icon at checkout. For security reasons, we do not store any payment information in our database.

No liability

While Acne Studios endeavors to keep your information private, in no event will Acne Studios be liable to you for any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of data, loss of programs, cost of procurement of substitute services or service interruptions) arising out of the use of or inability to use the Website, even if Acne Studios’ or its agents or representatives know or have been advised of the possibility of such damages. Acne Studios responsibility

Acne Studios liabilities to you are limited in each separate case to these Terms and Conditions unless otherwise is stipulated by law. In no case whatsoever will Acne Studios assume any liability for indirect damages such as loss of profit or in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. Acne Studios’ liabilities to you will never exceed your total purchase amount for each order. In case of force majeure, Acne Studios’ obligations will be suspended. The contract between you and Acne Studios can, in such cases, be partially or fully terminated by yourself or by Acne Studios.

Provisions severability

If any part of these Terms and Conditions are held to be invalid or unenforceable, such determination shall not invalidate any other provision of these Terms and Conditions; instead the invalid terms and conditions shall be replaced with other terms in order to give effect to the commercial intentions of these Terms and Conditions.

Claims resolution

Contact Acne Studios First

If a dispute arises between you and Acne Studios, our goal is to learn about and address your concerns. You agree that you will notify Acne Studios about any dispute you have with Acne Studios regarding these Terms & Conditions by contacting Acne Studios.

Binding Arbitration

You and Acne Studios agree, subject to section 26(G) (Protection of Confidentiality and Intellectual Property Rights), to submit any claim, dispute, action, cause of action, issue, or request for relief arising out of or relating to these Terms & Conditions or your use of the Products and/or Subscription Services to binding arbitration rather than by filing any lawsuit in any forum other than set forth in this section. Further you agree arbitration is final and binding and subject to only very limited review by a court. You also waive your right to any form of appeal, review or recourse to any court or other judicial authority, insofar as such waiver may be validly made.

This provision is intended to be interpreted broadly to encompass all disputes or claims arising out of or relating to your use of the Products. Subject to section 26(G) (Protection of Confidentiality and Intellectual Property Rights), any dispute or claim made by you against us or us against you arising out of or relating to these Terms & Conditions or your use of the Products(whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory) will be resolved by binding arbitration except that you may take claims to small claims court if they qualify for hearing by such a court.

Arbitration Procedures

You must first present any claim or dispute to Acne Studios by contacting us to allow us an opportunity to resolve the dispute. You may request arbitration if your claim or dispute cannot be resolved within 60 days after presenting the claim or dispute to Acne Studios. Acne Studios may request arbitration against you at any time after it has notified you of a claim or dispute in accordance with section 27(Notifications).

The arbitration of any dispute or claim shall be conducted in accordance with the then current and applicable rules of the American Arbitration Association as modified by this agreement. The place of any arbitration will be New York, NY, USA, and will be conducted in the English language. Claims will be heard by a single arbitrator. The arbitrator may not award relief in excess of or contrary to what this agreement provides, order consolidation or arbitration on a class wide or representative basis, award punitive or consequential damages or any other damages aside from the prevailing party’s actual damages, or order injunctive or declaratory relief, except that the arbitrator may award on an individual basis damages required by statute and may order injunctive or declaratory relief pursuant to an applicable consumer protection statute.

Any arbitration shall be confidential, and neither you, nor Acne Studios nor the arbitrator may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement or appeal of the arbitration award. Judgment on any arbitration award may be entered in any court having proper jurisdiction. If any portion of this arbitration section is determined by a court to be inapplicable or invalid, then the remainder shall still be given full force and effect.

No Class Actions

There shall be no right or authority for any claims subject to this arbitration section to be arbitrated on a class action or consolidated basis or on bases involving claims brought in a purported representative capacity on behalf of the general public (including, but not limited to, as a private attorney general).

Fees and Expenses

All administrative fees and expenses of arbitration will be divided equally between you and Acne Studios. Each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration hearing.

YOU MUST CONTACT ACNE STUDIOS WITHIN ONE (1) YEAR OF THE DATE OF THE OCCURRENCE OF THE EVENT OR FACTS GIVING RISE TO A DISPUTE, OR YOU WAIVE THE RIGHT TO PURSUE ANY CLAIM BASED UPON SUCH EVENT, FACTS, OR DISPUTE.

Protection of Confidentiality and Intellectual Property Rights. Notwithstanding the foregoing, Acne Studios may seek injunctive or other equitable relief to protect its confidential information and intellectual property rights or to prevent loss of data or damage to its servers in any court of competent jurisdiction.

Notifications

Acne Studios may provide notifications to you as required by law or for marketing or other purposes via (at its option) email to the primary email associated with your Acne Studios account, hard copy, or posting of such notice on the Acne Studios website. Acne Studios is not responsible for any automatic filtering you or your network provider may apply to email notifications. Acne Studios recommends that you add @acnestudios.com URLs to your email address book to help ensure you receive email notifications from Acne Studios.

Governing law

This agreement shall be governed by, construed and enforced in accordance with the laws of United States of America, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these terms, or any items purchased from Acne Studios, shall be filed only in the courts located in New York County, New York and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action, unless such action is required to be arbitrated as set forth in an above section.

Complete agreement

Except as expressly provided in a particular “legal notice” on the site, these terms & conditions, together with the privacy policy, constitute the entire agreement between you and Acne Studios with respect to use of the site and content.

    Acne Studios recognizes the importance of protecting the privacy of your personal data. We have instituted strict policies and security measures to protect the information you provide us.

  2. Who is responsible for the processing of your personal data?

    The Swedish company Acne Studios AB, reg. No. 556504-7726 (“Acne Studios”), is the controller of your personal data. Acne Studios’ affiliated companies (including other companies within the Acne Studios group, joint ventures, franchisees and licensees) and selected suppliers may process your personal data on Acne Studios’ behalf and in accordance with Acne Studios’ instructions as stated below and are thereby processors of your personal data.   3. Categories of data processed, purpose and legal basis for processing

    1. General

      Below is a summary of the categories of data that we process, the purposes of processing the data and on what legal basis we are processing your data. Our processing of your personal data partly depends on whether you have subscribed for membership with us or not. The processing of personal data relating to customers that are not members is described in section 3.2 below. The processing of our members’ personal data is described in section 3.3 below.

    2. Customers (non-members)
      1. Data collected when you shop in our webstore or use our online services

        Contact details: If you make a purchase online we will collect your name, address, e-mail address, telephone number, country of residence, date of birth, title (Ms./Mr. or other title) and social media account contact details (if any). Not all information is mandatory for making a purchase. We have marked mandatory information with the symbol (*) on our website. We will use your contact information to (i) process your purchase/orders and any returns, exchanges and complaints you may have relating to your purchase; and to (ii) communicate with you regarding your purchase and to answer and administer any questions or comments you may have regarding our products or services. The legal basis is that it is necessary to process your data in order for us to be able to fulfill our contractual obligations to you under the purchase agreement. We will retain your data for as long as necessary for this purpose. We may also process your contact details to keep you informed, via e-mail or other messenger services, of our special events or promotions. The legal basis is our legitimate interest of being able to market our products to our existing customers. We may use your contact details for direct marketing purposes for up to 12 months after your latest purchase subject to your ongoing right to opt-out. You are entitled to reject our marketing messages, that is, to opt out, at any time by clicking on the unsubscribe link included in each message or by contacting customer service at customercare@acnestudios.com.

        Credit card details: If you make a purchase online and chose to pay by credit card, you will provide your credit card information on our website to finalize your purchase. Your credit card details will be protected using Global Sign Encryption. The legal basis is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the purchase agreement. We will retain your data for as long as necessary for this purpose.

        Previous purchases and returns: If you have signed up for an account we will store information regarding (i) your online purchases and returns, and (ii) your purchases and returns in physical stores, if you have provided your e-mail address to our personnel. Such information encompasses product, size, price and date of purchase. We will also store information regarding your recently viewed items. This will allow you to keep track of your purchases and returns, and recently viewed items, by logging into your personal account. The legal basis is our legitimate interest to provide you with the service of a personal account as requested by you when you signed up for the account. You may choose to deregister your account at any time. We will also save information on your contact details and previous purchases and returns during 36 months after the purchase to be able to administer returns and/or complaints. The legal basis is our legitimate interest to provide our customers with speedy and efficient service after the purchase.

        Social Security number: If you chose to apply for credit, allowing you to make your payment by invoice, you may be required to provide your social security number on our website. Your social security number will be directly transferred and available only to our payment service provider, which will process your social security number to be able to obtain a credit report and to facilitate your payment. The legal basis is that the processing is necessary for us to ensure accurate identification of our customers for invoice purposes and to fulfill our contractual obligations to you under the purchase agreement. It is our policy to retain your social security number only as long as reasonably necessary for this purpose.

      2. Data collected when you shop in our physical stores

        If you make a purchase in one of our physical stores and request a digital receipt, we may process your e-mail address in order to be able to send the digital receipt to you. We will only collect your email address and send you a digital receipt if this has been requested or accepted by you. This processing is based on our legitimate interest of being able to provide our customers with a digital receipt on a voluntary basis.

    3. Members

      You may sign up for membership by subscribing to the services provided by Acne Studios in accordance with the Membership Policy. The membership is completely voluntary and subscribing for membership is not a requirement for purchasing Acne Studios’ goods. When you subscribe to become a member, you will enter into an agreement with Acne Studios (the Membership Policy).

      1. Data collected when signing up for membership

        When you sign up for membership (online or in Acne Studios’ physical stores), Acne Studios collects your name, address, e-mail address, telephone number, country of residence, date of birth, title (Ms./Mr. or other title) and social media account contact details. Acne Studios processes the data to create your personal account and to process the membership which includes certain features such as (i) sending digital receipts upon request when purchasing a product in a physical store, (ii) sending out invitations to special events/promotions, (iii) personalized services in store, and (iv) profiled marketing offers through email, SMS, letters, telephone, WeChat, Whatsapp and other social media. The legal basis is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the Membership Policy. We will retain your data for as long as necessary for this purpose.

      2. Data collected when shopping online

        Contact details: When you purchase a product online, Acne Studios will process your contact details for the following purposes; (i) to process purchases/orders and returns, exchanges and complaints; (ii) to communicate with you regarding the purchases and to answer and administer any questions or comments that you may have regarding Acne Studios’ products or services. The legal basis is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the purchase agreement.

        Previous purchases and returns: Acne Studios will also process data regarding your contact details and previous purchases and returns online (product, size, price and date of purchase) during 36 months after the purchase. The information will be processed for the following purposes:
        Administering returns and complaints. The processing is based on our legitimate interest to provide our members with speedy and efficient service after the purchase.
        Allowing you to keep track of your purchases and returns by logging into your account. The legal basis is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the Membership Policy.
        For the purpose of sending out invitations to special events/promotions, personalized services in store and profiled marketing offers through email, SMS, letters, telephone, WeChat, Whatsapp and other social media. The legal basis is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the Membership Policy.

        Credit card details: If you make a purchase online and chose to pay by credit card, you will provide your credit card information on the website for the purpose of making payment for the purchase. The legal basis is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the purchase agreement. As a member you may, but need not, also choose to have our system save your credit card details for future purchases, for the purpose of speeding up the checkout the next time you shop. The legal basis for this processing is your consent. We will retain your data for as long as necessary for this purpose.

        Social Security number: If you chose to request credit, allowing you to make your payment by invoice, you may be required to provide your social security number on our website. Your social security number will be directly transferred and available only to our payment service provider, which will process your social security number to be able to obtain a credit report and to facilitate your payment. The legal basis is that the processing is necessary for us to ensure accurate identification of our customers for invoice purposes and to fulfill our contractual obligations to you under the purchase agreement. It is our policy to retain your social security number only as long as necessary for this purpose.

      3. Data collected when shopping in physical stores

        When you shop in Acne Studios’ physical stores, Acne Studios may collect and store information regarding (i) your clothing and shoe size, (ii) your clothing preferences (such as preferred colors and style) and (iii) other shopping preferences, provided that you have shared this information with Acne Studios’ personnel on a voluntary basis. Acne Studios may also store data regarding your purchases and returns in physical stores (product, size, price and date of purchase) if you have provided your e-mail address to Acne Studios’ personnel. This information is processed for the purpose of enhancing your future purchasing experience with Acne Studios and to provide customized service, which is part of Acne Studios’ membership service. Acne Studios may also use the information regarding your shopping preferences for the purpose of sending out invitations to special events/promotions and profiled marketing offers through e-mail or other messenger services. The legal basis for this is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the Membership Policy.

      4. Data collected when using Acne Studios website services

        Acne Studios will store information regarding your recently viewed items when browsing Acne Studios’ website. This will allow you to keep track of your recently viewed items, by logging into your personal account. The legal basis for this is that the processing is necessary in order for us to be able to fulfill our contractual obligations to you under the Membership Policy. We will retain your data for as long as necessary for this purpose.

    4. Newsletter Subscribers

      If you have subscribed to one of our newsletters, we will process your name, email address, country and information on whether you are interested in womenswear or menswear for the purpose of sending out such newsletter. The legal basis for this processing is your consent. The newsletters may be sent to you until you unsubscribe to the newsletter service.

    5. Archive Subscribers

      If you have subscribed to receive information and updates via e-mail and text messages regarding Acne Studios Archive events, we will process your name, telephone number, e-mail address, country of residence and gender to send out information regarding Archive events. The legal basis for this processing is your consent. The information and updates regarding Archive events will be sent to you until you unsubscribe to the service.

    6. Customer service

      If you have contacted Acne Studios regarding a complaint, return or question, the e-mail or chat conversation will be stored for as long as it is necessary to administer your matter, including following up on the matter for a minimum of 12 months. Depending on the nature of the matter for which you are contacting us, the legal basis may be that our processing is necessary for us to be able to fulfill our obligations under the purchase agreement or Membership Policy, or that we have a legitimate interest of being able to communicate with individuals who contact our customer service.

    7. Anonymized data

      Please note that we may also use anonymized data (i.e. by removing personally identifiable information) for internal analysis, feedback, marketing and demographic studies to analyze, profile and monitor customer patterns in order for us to be able to improve our products and services. Because anonymized data does not include any personal data, it may be sold to or shared with others, or used for any purpose at Acne Studios’ discretion.

    8. Consent and withdrawal

      You hereby confirm that you have read and understood the content of this privacy policy. Where the legal basis for the processing of your personal data is your consent you agree to Acne Studios’ processing of your personal data in accordance with the provisions herein. Should you wish to object to, or withdraw your consent, to any of our processing, please contact us at customercare@acnestudios.com. Please note, however, that your withdrawal will not affect our right to process your data when such processing is necessary to perform our contractual obligations to you, and/or to the extent we are required to process your data by law or to defend ourselves in a dispute, to prevent fraud or abuse, or to enforce our Terms and Conditions. If you withdraw your consent to any consent-based processing, we will cease all such processing.

  4. Does Acne Studios share your information with others?

    Acne Studios does not sell or rent our customers’ personally identifiable data to any other entity.
    We may share your data with affiliated companies including other companies within the Acne Studios group, joint ventures, franchisees and licensees, and may be transferred to any assignees or successors in interest. If you have subscribed for membership with Acne Studios, we may combine your data provided to us with data that you have provided to such affiliated companies, for the purpose of improving our services to you, and to enhance your shopping experience when visiting an Acne Studios store in another country than your residence. The legal basis for the processing is that it is necessary for Acne Studios’ performance of the Membership Policy.
    Acne Studios may also share your data with selected suppliers so that they may perform functions on our behalf such as fulfilling orders and delivery of orders, processing payments, carrying out promotional services or data management, to maintain our website, to distribute e-mails, to send out our newsletter, to provide client communications and to manage our customer database. As necessary, the personal data you provide to us may be processed by these third parties, solely on Acne Studios’ behalf and in accordance with Acne Studios’ instructions as data processors. We do not authorize any of our suppliers to make any other use of your personal data.
    If Acne Studios and/or its subsidiaries are subject to an actual or potential merger or acquisition or similar transaction, we may share your data with potential and actual buyer(s) and their financial and legal advisers, subject to such third parties undertaking appropriate confidentiality.

  5. Your California privacy rights

    A California privacy law that went into effect on January 1, 2005, the "Shine the Light" law, allows California residents to obtain a list of third parties to whom a business has disclosed personal information if it shares such information with third parties for their direct marketing purposes. However, if a business adopts and discloses in its privacy policy a policy of not disclosing customers' personal information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, the business may comply with the law by notifying the customer of his or her right to prevent disclosure of personal information and by providing a cost-free means to exercise that right. As stated earlier in this Privacy Policy, personal information will not be shared with third parties for their direct marketing and promotional purposes. Because this Site has a comprehensive privacy policy and provides you with details on how you may opt-in or opt-out of the use of your personal information by third parties for direct marketing purposes, we are not required to provide you with the third party list.

  6. Transfer outside of the EU/EES

    We may share your data with our selected suppliers, who may process your data in countries both inside and outside of the EU/EES when performing functions on our behalf as set out in section 4 above.
    If you have subscribed to membership with Acne Studios, we will share your contact details and information on previous purchases and shopping preferences with our affiliated companies both inside and outside of the EU/EEA (please see further under section 4) Please note that countries outside of the EU/EEA may not provide an adequate level of protection for your personal data. Acne Studios has however taken appropriate safeguards to ensure that the receiving parties of your data in countries outside of the EU/EEA shall provide an adequate protection of your data. Such safeguards may be that the receiving party has joined the Privacy Shield (if the receiving party is a company established in the United States) or that the receiving party has signed so called standard data protection clauses adopted by the EU Commission. Please contact us at customercare@acnestudios.com if you want further information on what safeguards have been taken and if you want a copy of such safeguards.

  7. Your data subject rights

    In this section 7, we have summarized your data subject rights to request access, portability, rectification, erasure of your personal data, to restrict the processing of your personal data, to object to processing, and your right to lodge a complaint with the supervisory authority.
    If you want to exercise your rights, please send us an email at customercare@acnestudios.com. Please note however that if you want to lodge a complaint with the supervisory authority, you need to contact the authority directly.
    If you have signed up for a membership with Acne Studios you will also be able to access, rectify and erase some of your data by logging in to your private account. Login to your account
    Notwithstanding anything to the contrary herein, Acne Studios reserves the right to keep and process your personal data in accordance with this policy to the extent necessary to perform our contractual obligations to you, and to the extent we are required to process your data by law or in order to defend ourselves in a dispute, to prevent fraud or abuse, or to enforce our Terms and Conditions.

    Right of access
    You have the right to obtain confirmation of whether personal data concerning yourself are being processed and, where that is the case, access to the personal data and information regarding, inter alia, the purpose of processing, the categories of personal data concerned, the categories of recipients to whom your data have been or will be disclosed, and the envisaged period of time for which personal data will be stored (or the criteria for determining this).

    Right of rectification
    You have the right to request rectification of inaccurate personal data concerning yourself, and to complete incomplete data.

    Right of erasure
    Under certain circumstances you are entitled to request that we erase your personal data or restrict our processing of your data, namely in the following events.
    When it is no longer necessary for us to process your data taking into consideration the purposes for which it was collected.
    When our processing is based on your consent and you have withdrawn your consent, and there is no other legal basis for the processing of your data.
    When our processing of your data is based on a legitimate interest legal basis and you object to such processing, and there is no overriding legitimate ground for our processing.
    When you have objected to our processing of your data for direct marketing purposes.
    When your personal data has been unlawfully processed.
    When the personal data must be erased for compliance with a legal obligation that applies to us.
    When the personal data collected concerns a child (under 13 years of age) in relation to the offer of information society services.

    Right to objection - direct marketing and profiling
    You have the right to object at any time to our processing of your personal data for direct marketing purposes, which includes profiling to the extent that it is related to such direct marketing. If you object to our processing of your personal data for direct marketing purposes, including profiling, we will cease such processing of your data.

    Data portability
    If our processing is based on your consent or if the processing is necessary for our performance of a contract with you, you have the right to request that the data which you have provided to us shall be provided to you in a structured, commonly used and machine-readable format and you also have the right to transmit such data to another controller.

    Right to lodge a complaint with supervisory authority
    Please note that if you consider the processing of your data to be in violation of applicable data protection laws, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence or the place of the alleged infringement.

  8. How do I unsubscribe from Acne Studios newsletters and emails?

    If you do no longer wish to receive our newsletters or other emails, you can unsubscribe as indicated in the particular communication, i.e. by using the unsubscribe link which is included on all newsletters and other emails. You may also contact us at customercare@acnestudios.com.

  9. How long do we keep your data?

    We will retain your personal information for as long as necessary in relation to the purposes for which the data was collected or otherwise processed. Under section 3 above, we have specified the retention time, or the criteria for determining the retention time, for our processing of data in relation to the different purposes the data is being processed. In addition to the retention time stated under section 3 above, please also note the following.
    Members: If you have not made any purchases, logged in to your account or used any of our services during a consecutive period of 36 months, we will terminate your membership and consequently we will not use your data for any membership services or marketing purposes thereafter. In such case we will delete your data unless we need to keep it for other purposes that are legally justifiable.
    We will retain your personal information as necessary to comply with applicable legal obligations, to resolve disputes, and to enforce our agreements. Statutory obligations to retain data further remain unaffected.

  10. Is it mandatory to provide personal data?

    When you purchase our products online, or sign up for a membership with Acne Studios, we will inform you which data is mandatory by marking certain fields with a symbol (*). The provision of mandatory data is necessary for Acne Studios to be able to fulfill our contractual obligation to you, for example processing your order, or fulfilling the membership services requested by you.
    When you purchase our products in our physical stores, you do not have to provide any personal data. Please note however that if you chose to receive a digital receipt, it is mandatory that you provide your e-mail address or otherwise we will not be able to send you the digital receipt.

  11. Children's privacy and legal purchase age

    Children should always ask parents for permission before providing any personal information online. No information should be submitted to Acne Studios by any person under the age of 16 without the consent of a parent or guardian. Unless otherwise disclosed during collection, Acne Studios does not knowingly collect any personally identifiable information about persons under the age of 16, provide any personally identifying information about such persons under the age of 16, regardless of its source, to third parties, and does not knowingly use such information for any marketing or promotional purposes.
